I am now less inclined to mention the show to a friend. I understand all of the legal mumbo-jumbo but I think you people should be flattered rather than infuriated by the use of these things without your express permission. If people are going to such great lengths to gather these things, they are most likely devoted viewers who want to share what their passion for the show. Some parts of the world are not as fortunate as the US and are still in 2nd season reruns and would like to know what is going on with their favorite show. These sites should show all of you that even though it was not exactly legal, the people who run them did it for loyal viewers. I feel that if you are to make these people take down all of the screen savers, etc. you might as well make them take down all of the fanfic that you have not given your permission to. Television and radio began as a way to get news to the masses, to entertain them, and to bring a spark into the silent night of our homes. Over the years, an industry has grown up about television, and with it comes an old creature called fandom. There have been fans ever since there have been radio shows. But today we live in a high- tech society, where people can express their fandom in ways never dreamed of by our parents and grandparents. The relationship between fans and their interests is a delicate one, and it is not always apparent. In the late sixties, Star Trek was threatened with cancellation, and immediately a completely unsuspected mass of fans began a campaign to restore it. And it worked. A precedent was established, and there have since been several instances where the wishes of fans have influenced a program's existence, and indeed, increased the amount of money returned to it. Today, we have the internet, and through the media of sight sound, and the written word, fans have been able to show their love in new and rich ways. They are supported by their programs, and in the end, the programs are supported by the fans. With millions of people online, television shows such as the X-Files have been given coverage unheard of in even the last decade. Yet, now, networks such as Paramount and Fox have decided that fans are unimportant. Disregarding the fact that over 90% of all fan-based web-sites are absolutely non-profit, the corporate big boys have decided even mentioning the programs name in some cases compromises a violation of copyright. They see an opportunity to make more money by creating their own sites online, sites that offer as much as fan-based ones, yet which demand a fee. Or, worse yet, they simply do not wish to view the originality and the often times reamrkable skill that the fans portray their favorite shows. It is a fact that posting copyrighted material for monetary gain is illegal. It is also a fact that all NON-PROFIT use of same materials is NOT a violation. It is, rather, a homage. It is free advertising for these shows which inevitably draw in even more fans, and boost their ratings as well. But there is a dangerous tendency in corporate America to lean towards facism. In a purely totalitarian movement, corporations have begun to excise these fan sights from the Internet. What can be next? Under their reasoning, everything from a multemedia web site to a child's picture drawn in the classroom is subject to legal suit. They have taken the first steps towards a monopoly of speach and its freedoms. This moves beyond the question of whether or not someone has the right to post a sound clip from their favorite tv show on the internet. It boils down to the age old question of Freedom of Speech vs. Money. The corporations would see our individual rights of expression yanked away without question. Where has the highly vaunted sense of American justice gone? Where have the ideals that our country was founded on gone? Into the pocket of corporate America. The future is here indeed. Guard your children, and teach them never to express their interest in a television show, lest they immediately be surrounded by lawyers and legal thugs. Remind them that they live in a world of riches for the imagination, but that such a world can only be glimpsed, never possessed. Or...these corporations could look out there, and realize that they are missing nothing. They are losing nothing. They are, in fact, gaining MUCH with every fan who creates a non-profit web-site of adoration. They can realize all of this, but only if they allow the haze of greed to dissapear from their vision. If FOX were to license Pam's site as a "legal" site it would make things even more wonderful. And we could enjoy everything even more with less stress for her. The only thing this harrassment of webmasters/mistresses of X-Files sites accomplishes is to infuriate fans and discourage enjoyment of it. And I know this is true of the vast majority of online philes - what we can access on the web just enhances our enjoyment of the show. I am a dedicated fan who would just about buy any merchandise reasonably within my budget, even if I know my money could be put to better use. It's not just me -- I know there are literally legions of fans who would spend significant amounts of money on official products, regardless of whether sound files or video clips are available on the Internet. For although one can download files off the Internet, the size and quality make buying officially licensed videos, etc., still more viable. Therefore, I ask that you reconsider your policy; nothing is gained from shutting down major portions of fan websites (i.e. sound and video clips), but multitudes are angered and free publicity is lost. After every episode, I always look forward to surfing the web and looking into these websites to see what new updates are available in terms of screen captures and sound files which might capture crucial and/or memorable moments of the show. The "official" FOX website is poorly maintained and infrequently updated in general and therefore is of little interest to me and many other X-philes I know of. We need websites like XFMMA that is truly for the fans. Since websites like that is created by a fan, the webmistress or webmaster usually understand what we as loyal viewers of the show like. Websites like XFMMA have never detracted from the show, in my opinion. In fact, as even the media has mentioned many times, they were the initial cult base for the show. These vast number of websites erected in honor of the X-files contributed greatly to the popularity of the show by helping it catch the attention of the general public and media in the first place. To shut fan sites like XFMMA down now that the X-Files is popular can really only be seen as an act of betrayal. It's like biting the hand that fed you. I understand that copyright laws and regulations are a concern, but I'm sure a compromise can be reached somehow which would allow XFMMA to continue on while still protecting your company's copyrights. That's a nice little number, but if I know Mr. Murdock like I think we all do, that nice little number would be nicer if it was a nice big number. Now how on earth do you do that? You can't just invent ratings. We need to get more viewers...hmmmmmmm....Oh! I got it! I got it! Pick me! Pick me!!!! Let's *ADVERTISE*!!!!! Alright, now we've decided how to get more viewers. Let's look at the details: Advertising costs. That's mucho $$$ and a few cents for our big friend the M-man. And if I understand correctly, he, like everyone else on this great big blue dirt ball, doesn't like to *SPEND* that money. Well, there's a great way to get some free advertising in. Let me tell you all about it. On the internet there's a site for just about anything you can think of. Large, small, good and not-so-good. Nonetheless, it's like a giant billboard advertising what ever we want it to. In this case, Ms. Versaphile was advertising your show....for how much? What? Oh, you must be joking....*FREE*?!?!?!?!?!!! Did Mr. Murdock know this? She was saving him millions in advertising dollars --spending her OWN money to keep this "unofficial fox site" open-- for the X-Files? And the lawyers Mr. Murdock hired to SAVE him money took her site, peeled the life and core right out of it, threw it back to the dogs and then told her she was ok now because the site was officially unofficial fox material...what's wrong with this picture? I have an "unofficial" fox screen saver that *I* made with *MY* Macintosh AND YES, I have given it away to just about all of my friends. It's an X-Files screen saver that I hacked out myself. And if Fox ever tried to wipe that off MY hard drive, they'd have to peel my cold hard body off of it first! Now on top of all of that, I don't know a soul in advertising who would ever tell you that it's WRONG for someone to make something that will be staring them in the face everytime they turn on their computer advertising YOUR show and charge you NOTHING for it! Just think about that. These screen savers and sounds and pictures and video clips of the show that Ms. Smith has are all free. People download them to their computer so it's going to be staring them in the face. How sensible is it for you to charge people to see this? No one wants to pay money to see your commercials. Give it to them and they just might watch. How much more could you ask for? The screen savers espcially are a God-Send! Why? Because people will turn on their computer to see what? Your show's logo. And they'll give it to friends. Their friends will do the same. All of this just to see your free ads. Sitting on their computer screens at no cost to you. What more do you want? Short of total control of the planet, you've already got it all! And to closedown a site that is nothing but an archive of all these billboards, commercials, and hypnotizing-mind-controlling blather --stuff that, may I remind you, you PAY other companies to shoot out like eggs from an chicken-- to close down a site like that is like breaking the first commandment! I have also bought everything that I could, that was of X-files origin ranging from magazines with The X-Files on it to going to the First X-Files convention, Trading cards, CDs, the videos with two episodes each on them, etc... I couldn't tell you how much money I have already spent on products of The X-Files and 20th Century Fox and any other company involving the X-Files. I enjoyed being able to download sound files, video clips, desktop themes, screen savers, etc, from the web sites out there. You could get some pretty funny sound clips for your computer sounds. The way I see it is having sound clips and other media out on the internet will attract people. if someones web site were to say "You have to download this clip, it's the funniest one out there" They might just do that and find out The X-Files is a good show. They get stuck on it, and therefore they buy merchandise involving The X-Files like everyone else out there buying X-Files merchandise. That's where I would stop buying. The internent is something we have to pay for already, but with buying access to it we are able to get FREE stuff from it, that's the point of Internet all together. It makes life easier. I'm a newbie. I began watching the show at the end of the fourth season. Even then, it was a good show, but nothing too important. Then I got the internet, and with it came all of these incredible sites with sound clips, pictures, etc. All of this multimedia stuff hooked, me! It peaked my interest and made me the crazy fan you see today. Through these sites I was able to catch up on the show's mythologies, which I'm sure you know are quite...intricate. Now these audio and video clips didn't discourage me from buying the videos or watching the episodes! Why in the world would they? They heightened my interest! Do you believe that after viewing the scene in Scully's apartment in "Small Potatoes" that I wouldn't bother to watch the rest of the episode? Much to my dismay none have appeared. It seems that the only way to get FOX approved multimedia, is to go and buy 'The X-Files Unrestricted Access CD-ROM'. While the CD-ROM is cool and has many fine features within, it does not hold a candle to what can be found on fan sites. Fans build their sites from a different perspective and therefore add a new dimension to the X-Files world. This dimension should be encouraged and explored, not removed. After all, without the fansites, the X-files phenomenon would not have grown as it did and the show would never make the impact it now does. I would like to think that having fansites do not take away from the official merchandise that FOX offers, but instead compliments it. I have purchased both the CD-ROMS and all the videos available. They are a proud part of my X-Files collection and are greatly complimented by the things I can download from fansites. I think that FOX should back off and allow fansites to continue or they may find a backlash is created when fans stop buying the official merchandise as a protest. If FOX does not want to back away from the closure of archives like XFMMA, then they should at very least look to an alternative route of licensing certain sites to compliment their own web presence. Never missed it. I still get a kick out of watching the reruns on the Sci-Fi Channel, but it has lately occurred to me how relentlessly cheesy the series actually was! So what kept it going for as long as it did, besides Darren McGavin's masterfully deadpan narration and his performance? Two words: THE FANS. What finally killed Kolchak? Not a yeti, or a headless biker, or even Dracula. It was a force more insidious than all of them combined: the greed of corporate broadcasters, convinced that the show had "outlived its usefulness." Now Kolchak has found a new life and a new set of fans. Food for thought, isn't it? For my own defense, I can only say this--maybe I would've learned a lot about computers and the Web on my own, but before X FILES, I didn't know HTML or JPEG's from a hole in the ground. My fascination with the series and its characters has not only inspired me to build what was my first webpage and create music for it, but thanks to a network of supportive, like-minded fans all over the world, I have developed the skills that have enhanced and enriched my life in ways I never dreamed were possible. And that's just me. Think of all the other people who feel the same way. Think of what would happen to them and their sites if you put a stamp of prohibition what they're doing. Think of what will eventually happen with the backlash if this continues. The time to consider not biting the hand that feeds you will be long past, if you only think about it after enough fans have boycotted the series to send it down into ratings hell. Don't think it will happen? Even Kolchak got cancelled. Is there an answer--YES. Establish a source that all XF Fans and webmasters can draw from, that contains content pre-approved for public web use by 1013, Mr. Carter and Fox. And if you charge a nominal fee for it, so be it. This actually fed my obsession, and I'm still living it almost five years later. I've no doubt that I wouldn't like the X-Files as much had it not been for the internet. The pictures, sounds and videos that are on the internet are not intended to rob you of copyright rights, we're merely fans having fun, and its actually free publicity for the show. None of this has deterred me from buying official merchandise - if you saw the amount of X-Files stuff I own you'd probably faint. The pictures, videos and sounds on the internet are good, but nothing beats the video and audio quality of official videos, or the information that's published in official books and guides. However, I'm disappointed by the partial closure of the XFMMA, as it was one of the best resources on the web. If you shut down the Internet sites, all you are doing is making the fans angry and I'm wondering what ever happened to advertising on the Internet. Most of the Xfiles fans I'm willing to bet are on the Internet and we all love to be able to download the pictures, wave files, screensavers, we find info on books that we go out and purchase, and purchase T-shirts among countless other Xfiles material (that is what this household does and I'm sure all other Xfiles fan's households too). For example finding out about Xfiles Unrestricted access out on the Internet at an Xfiles site and we went out and got it immediately...just like the Xfiles Game. No site could or has ever stopped us from using/buying FOX material, but if anything encouraged us to buy more and more. It is insulting to believe that FOX is actually considering shutting down such sites...as a fan I consider that a slap on the face. We have been loyal fans since day one of the show and remain fans because of the whole nature of the show, the fellowship among Xfiles fans, and the loyalty towards the show that is found on the Internet with all the sites out there. Please, free speech (and everything that goes with it) out there! 097) Okay, here's why FOX should let X-Files sites (like the XFMMA) stay open: First) X-Files fan sites are FREE advertising for FOX and 1013, and from what I know about marketing (which, admittedly, isn't much) free advertising is usually a GOOD thing. Something you DON'T want to shut down. Those ads in TV Guide and on bill bords and in other magazines, you have to pay for, but all these fan sites are completely free and praise the show repeatedly. Take this example: There's a girl who's a devoted fan of The X-Files. We'll call her Dana. Dana's chatting in a chat room one day, when she meets another girl, Samantha. She tells Samantha what a great show The X-Files is. She tells Samantha to check out her website. (Which is loaded with images and sounds, since FOX hasn't gotten to it yet.) Samantha, not being a sci-fi fan as a result of a traumatic childhood incident involving aliens (but that's another story), reluctantly checks out Dana's site. She sees all the images from The X-Files and the movie, checks out the .wavs and the .avis and decides that The X-Files looks like a good show. If FOX is shutting down sites becuase they think that if we fans can get stuff off the internet, we won't buy official X-Files merchandise, they are WRONG. Let me tell you, from a first person point of view, this is NOT true. There are plenty of things that X-Philes love that we just can't get off our computers: T-Shirts, books, novelizations of episodes, audio tapes of novelizations of episodes, posters, mugs, hats, keychains, trading cards, those wonderful X-Files novels by Kevin J. Anderson, the audio tapes of those wonderful novels (Especially when they're narrated by the stars of the show!), video tapes of the episodes, EVERYTHING! We want it all! Having Multimedia archives on the internet does not prevent us from wanting to buy everything else there is that relates to the X-Files. Take it from me: No amount of .gifs and .wavs that I can get off my computer will stop me from spending my allowance on any X-Files merchandise I can get my obssesive little hands on. So, you see, it's in the interest of everyone involved to keep the sites up and running and to encourage the creation of more of them, not to shut them down. One day, I went on the Internet and went into an X Files chat room and was amazed about all the information everyone knew about the show, the writers, and even how many more years David and Gillian's contracts for the show would last. I asked them how they got this information, and they told me they got it on X Files webpages. And since I haven't been watching the show forever, I figured it was a good idea to get some background information about the show. So I went to the official site. Lots of good info, but I admit it was a bit boring. AND it didn't have any multimedia to jazz it up, except for a few video segments. I'm thinking, 'Come on, I know this was a GREAT show, and they don't even have good video clips.' Still, I went to another chat room, and saw all these great pictures (best of all, they were 'shippy pictures!). So I asked them where they got their pics, and they said X Files sites. So this time, i went to the unofficial web pages and was amazed at what FOX had been holding out on me! Sounds, images, video clips, music videos, screen savers, desktop themes, and so much more!!!! I was in heaven!!!!! After a few weeks, I was OBSESSED. I became a true X Phile. After watching the X Files every week, I could read reviews of it by other 'shipppers, get great pictures and sounds from that particular episode, and I could also get these things from past episodes, too, which was great for me because I only started watching the show a little over a year ago. And I could decorate my computer with icons and desktop patterns and everything. But these pages did not stop me from going out and buying T-shirts, posters, magazines, soundtracks, etc. Actually, the web sites are what made this show my favorite, and I am sure other fans agree. These sites are what make The X Files such a fantastic show. They DO NOT hurt you at all, they HELP you. They promote the show, they make us want to go out their and buy everything we fans can get our hands on. They are basically a big fat advertisement for the show, AND for the movie!!!! I know that you will hurt your show and so many of its fans by shutting down theses sites. You will make less money, you will be destroying a good thing. Please, let us advertise for you for FREE. We love doing it, really, we do. Please, let us enjoy the show, let us make it one of the greatest shows of all time. These pages have opened my eyes and showed me that this show really is great, something my brother couldn't do. Let us continue this for others out there who don't know anything about the show. I feel strongly that allowing people to be exposed to and share my creation can only be to my benefit, since I know that if they like it, they will want more of it and will be glad to pay for it. Since I didn't follow the show from the first season, I was confused and lost when first watching the show (midway through season three). But thankfully these websites provided me with numerous episode guides, information and even some clips to well aquaint me with the show. Downloading a few sound clips from a website doesn't stop us from buying X-Files merchandise, it only adds to our enjoyment and feeds the fanaticism that keeps the show a cult favorite. These people put in their time and their efforts to make these really great web sites, and they're proud of them. A proud fan is a happy fan. You take away people's ways of showing how much they love their show, and they fight back. I think you're all aware of that. No one with their X-File websites ever intended to make trouble. That's pretty obvious. Unlike The X-Files, there's no complicated conspiracy here. *We are all just showing how much we love the show, plain and simple.* I don't think anyone is taking anything away from the licensed merchandise sales like you think the sites will do. We're just showing our support, that's all. And now . . . perhaps you didn't figure this in, but do you know just how many X-File sites there are out there? And within each X-Files site, how many pictures does each one have? Sound files, .midi files, fanfic, the whole shootin' match? And then, there are the new X-File sites that pop up while others are being taken down. The more you try to take X number of sites down, X number of sites pop up with their huge display of various forms of multimedia. The point I'm getting at is that in fact, this might take some cash out of your wallets as well, more than you'd want taken out. The sheer time and effort it would take to scan the entire Web and the Internet for all these things you say webmasters should pay royalties for would be staggering. And taking out the sites is like digging a hole with people up on the surface shoveling the dirt right back in. It's just not very practical at this rate. If anything, I think the sites are helping you out, giving you some free advertising. The scale of this kind of an advertising scheme would cost you so much money. Be grateful there are a lot of webmasters out there who are showing how much they love The X-Files while also helping to advertise and promote the series. I don't think it's much of an exaggeration to say the show wouldn't be doing as well if there weren't any other sites besides the official X-File site. So this is my two cents.
